ในกรณีที่ผู้อุทธรณ์ไม่พอใจคำวินิจฉัยของคณะกรรมการพิจารณาอุทธรณ์ ผู้อุทธรณ์มีสิทธิฟ้องเป็นคดีต่อศาลภายในกำหนดสามสิบวันนับแต่วันได้รับแจ้งคำวินิจฉัยอุทธรณ์ เว้นแต่ คณะกรรมการพิจารณาอุทธรณ์จะจำหน่ายอุทธรณ์ตามมาตรา ๔๖
