พนักงานเจ้าหน้าที่ตามพระราชบัญญัตินี้ผู้ใดกระทำโดยประมาทเป็นเหตุให้ผู้อื่น ล่วงรู้ข้อมูลคอมพิวเตอร์ ข้อมูลจราจรทางคอมพิวเตอร์ ข้อมูลของผู้ใช้บริการหรือข้อมูลอื่นที่เกี่ยวข้องกับ ระบบคอมพิวเตอร์ ที่ได้มาตามพระราชบัญญัตินี้ ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกิน สองหมื่นบาท หรือทั้งจำทั้งปรับ
