ถ้าเจ้าพนักงานพิทักษ์ทรัพย์ก่อให้เกิดความเสียหายขึ้นแก่กอง ทรัพย์สินในคดีล้มละลายโดยเจตนาร้ายหรือประมาทเลินเล่ออย่างร้ายแรง ศาลมีอำนาจสั่งให้เจ้า พนักงานพิทักษ์ทรัพย์ชดใช้ค่าเสียหายเป็นส่วนตัวตามที่เห็นสมควรได้
