ถ้าไม่ได้ตั้งกรรมการเจ้าหนี้ไว้ การกระทำใดๆที่พระราชบัญญัตินี้ กำหนดไว้ว่า ต้องได้รับความเห็นชอบจากกรรมการเจ้าหนี้ก่อนนั้น ให้เจ้าพนักงานพิทักษ์ทรัพย์ขอ ความเห็นชอบจากที่ประชุมเจ้าหนี้
