ผู้ใดประสงค์จะขอใบอนุญาตขับรถ ต้องเป็นผู้มีคุณสมบัติและไม่มี ลักษณะต้องห้ามตามพระราชบัญญัตินี้ และยื่นคำขอต่อนายทะเบียนแห่งท้องที่ที่ตนมีภูมิลำเนาหรือมี ถิ่นที่อยู่ การขอใบอนุญาตขับรถและการออกใบอนุญาตขับรถ ให้เป็นไปตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่กำหนดในกฎกระทรวง
