ภายใต้บัคับมาตรา ๒๗และมาตรา ๖๘เมื่อได้จดทะเบียน เครื่องหมายการค้าแล้ว ผู้ซึ่งได้จดทะเบียนเป็นเจ้าของเครื่องหมายการค้า เป็นผู้มีสิทธิแต่เพียงผู้เดียว ในอันที่จะใช้เครื่องหมายการค้านั้นสำหรับสินค้าที่ได้จดทะเบียนไว้ มาตรา ๔๐วรรคสองแก้ไขเพิ่มเติมโดยพระราชบัญญัติเครื่องหมายการค้า (ฉบับที่ ๓)พ.ศ. ๒๕๕๙ มาตรา ๔๒แก้ไขเพิ่มเติมโดยพระราชบัญญัติเครื่องหมายการค้า(ฉบับที่ ๒)พ.ศ. ๒๕๔๓
