ถ้ามิได้ำหนดไว้เป็นอย่างอื่นในนิติกรรมอันก่อให้เกิดภาระจำ ยอมไซร้ท่านว่าภาระจำยอมย่อมติดไปกับสามยทรัพย์ซึ่งได้จำหน่าย หรือตกไปในบังคับแห่งสิทธิ อื่น ท่านว่าจะจำหน่าย หรือทำให้ภาระจำยอมตกไปในบังคับแห่งสิทธิอื่นต่างหากจาก สามยทรัพย์ไม่ได้
