ถ้าลูกหนี้โต้แย้งการริบเบี้ยปรับโดยอ้างเหตุว่าตนได้ชำระหนี้แล้ว ไซร้ท่านว่าลูกหนี้จะต้องพิสูจน์การชำระหนี้ เว้นแต่การชำระหนี้อันตนจะต้องทำนั้นเป็นการให้งด เว้นการอันใดอันหนึ่ง
