Section ๓๙๗

ถ้าผู้จัดการทำกิจอันใดซึ่งเป็นหน้าที่บังคับให้ตัวการทำเพื่อ สาธารณประโยชน์ก็ดี หรือเป็นหน้าที่ตามกฎหมายที่จะบำรุงรักษาผู้อื่นก็ดี และหากผู้จัดการมิได้ เข้าทำแล้วกิจอันนั้นจะไม่สำเร็จภายในเวลาอันควรไซร้ การที่ได้ทำขัดกับความประสงค์ของตัวการ เช่นนั้น ท่านมิให้ยกขึ้นเป็นข้อวินิจฉัย
