ผู้ขนส่งจะต้องรับผิดต่อคนโดยสารในความเสียหายอันเกิดแก่ตัว เขาหรือในความเสื่อมเสียอย่างใดๆอันเป็นผลโดยตรงแต่การที่ต้องชักช้าในการขนส่ง เว้นแต่ การเสียหายหรือชักช้านั้นเกิดแต่เหตุสุดวิสัยหรือเกิดแต่ความผิดของคนโดยสารนั้นเอง
