เมื่อเจ้าหนี้ทวงให้ผู้ค้ำประกันชำระหนี้ ผู้ค้ำประกันจะขอให้เรียก ลูกหนี้ชำระก่อนก็ได้ เว้นแต่ลูกหนี้จะถูกศาลพิพากษาให้เป็นคนล้มละลายเสียแล้ว หรือไม่ปรากฏ ว่าลูกหนี้ไปอยู่แห่ ใดในพระราชอาณาเขต
