การที่จะตกลงกันไว้เสียแต่ก่อนเวลาหนี้ถึงกำหนดชำระเป็น ข้อความอย่างใดอย่างหนึ่งว่า ถ้าไม่ชำระหนี้ ให้ผู้รับจำนองเข้าเป็นเจ้าของทรัพย์สินซึ่งจำนอง หรือ ว่าให้จัดการแก่ทรัพย์สินนั้นเป็นประการอื่นอย่างใดนอกจากตามบทบัญญัติทั้งหลายว่าด้วยการ บังคับจำนองนั้นไซร้ ข้อตกลงเช่นนั้นท่านว่าไม่สมบูรณ์
