ถ้าคู่สัญญาได้กำหนดราคาแห่งมูลประกันภัยไว้ ผู้รับประกันภัย ชอบที่จะได้ลดจำนวนค่าสินไหมทดแทน ก็แต่เมื่อพิสูจน์ได้ว่าราคาแห่งมูลประกันภัยตามที่ได้ตก ลงกันไว้นั้นเป็นจำนวนสูงเกินไปหนัและคืนจำนวนเบี้ยประกันภัยให้ตามส่วนกับทั้งดอกเบี้ยด้วย
