ธนาคารจำต้องใช้เงินตามเช็คซึ่งผู้เคยค้ากับธนาคารให้ออกเบิก เงินแก่ตน เว้นแต่ในกรณีดั่งกล่าวต่อไปนี้ คือ (๑)ไม่มีเงินในบัญชีของผู้เคยค้าคนนั้นเป็นเจ้าหนี้พอจะจ่ายตามเช็คนั้น หรือ (๒)เช็คนั้นยื่นเพื่อให้ใช้เงินเมื่อพ้นเวลาหกเดือนนับแต่วันออกเช็หรือ (๓)ได้มีคำบอกกล่าวว่าเช็คนั้นหายหรือถูกลักไป
