[๗๐] พยานที่ได้รับหมายเรียกโดยชอบดังที่บัญญัติไว้ในมาตรา ๑๐๖และมาตรา ๑๐๗ นั้น จำต้องไปณสถานที่และตามวันเวลาที่กำหนดไว้ เว้นแต่มีเหตุเจ็บป่วยหรือมีข้อแก้ตัวอันจำเป็นอย่างอื่นโดยได้ แจ้งเหตุนั้นให้ศาลทราบแล้ว และศาลเห็นว่าข้ออ้างหรือข้อแก้ตัวนั้นฟังได้
