พระมหากษัตริย์ทรงไว้ซึ่งพระราชอำนาจในการประกาศใช้และเลิกใช้กฎอัยการศึก ในกรณีที่มีความจำเป็นต้องประกาศใช้กฎอัยการศึกเฉพาะแห่งเป็นการรีบด่วน เจ้าหน้าที่ฝ่ายทหาร ย่อมกระทำได้ตามกฎหมายว่าด้วยกฎอัยการศึก
