ข้อ ๕ กรณีที่ภาชนะบรรจุหรือหีบห่อที่บรรจุสารระเหยมีขนาดบรรจุเกิน ๕๕๐ มิลลิลิตร หรือเกิน ๕๕๐ กรัม หากได้จัดให้มีภาพ เครื่องหมาย หรือข้อความที่ภาชนะบรรจุหรือหีบห่อที่บรรจุ สารระเหยตามกฎหมายอื่นแล้ว ผู้ผลิตหรือนำเข้าสารระเหยจะไม่ดำเนินการตามข้อ ๓ ก็ได้
