เมื่อข้าราชการตำรวจผู้ใดถูกจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุกในความผิด ที่ได้กระทำโดยประมาทหรือความผิดลหุโทษ ซึ่งยังไม่ถึงกับจะต้องถูกลงโทษปลดออกหรือไล่ออก หากจะให้รับราชการต่อไปจะเป็นการเสียหายแก่ราชการ ก็ให้ผู้มีอำนาจตามมาตรา ๑๐๕ สั่งให้ผู้นั้น ออกจากราชการเพื่อรับบำเหน็จบำนาญเหตุทดแทนได้
