ผู้ใดเป็นเจ้าพนักงานมีตำแหน่งหน้าที่ปฏิบัติการตามพระราชบัญญัตินี้และได้ล่วงรู้ หรือได้มาซึ่งความลับของผู้อื่นเพราะการปฏิบัติการตามตำแหน่งหน้าที่ นำความลับนั้นไปเปิดเผย นอกอำนาจหน้าที่ของตน โดยประการที่อาจจะก่อให้เกิดความเสียหายแก่ผู้อื่น ต้องระวางโทษจำคุก ไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ
