ในกรณีที่ผู้รับทุนมิได้เปิดเผยผลงานวิจัยและนวัตกรรมใดตามมาตรา ๗ วรรคหนึ่ง หรือกรณีที่ผู้รับทุนและนักวิจัยไม่ประสงค์จะเป็นเจ้าของผลงานวิจัยและนวัตกรรมใด หรือไม่ดำเนินการตามระเบียบที่คณะกรรมการกำหนดตามมาตรา ๘ วรรคสี่ ให้ผลงานวิจัยและ นวัตกรรมนั้นเป็นของผู้ให้ทุน
