การเข้าชื่อเสนอข้อบัญญัติท้องถิ่นในเรื่องที่อยู่ในหน้าที่และอำนาจขององค์กร ปกครองส่วนท้องถิ่นนั้นให้กระทำได้ แต่หากเป็นการเข้าชื่อเสนอข้อบัญญัติงบประมาณรายจ่ายประจำปีและ ข้อบัญญัติงบประมาณรายจ่ายเพิ่มเติมจะเสนอได้ก็ต่อเมื่อมีคำรับรองของผู้บริหารท้องถิ่นตามมาตรา ๑๒
