ถ้าโดยพฤติการณ์พึงคาดหมายได้ว่าเขารับฝากทรัพย์ก็เพื่อจะ ได้รับบำเหน็จค่ ฝากทรัพย์เท่ นั้ ไซร้ ท่านให้ถือว่ เป็อัได้ตกลงกัแล้วโดยปริยายว่ามี บำเหน็จเช่นนั้น
