เจ้าของรวมคนหนึ่งๆ อาจใช้สิทธิอันเกิดแต่กรรมสิทธิ์ครอบไป ถึงทรัพย์สินทั้งหมดเพื่อต่อสู้บุคคลภายนอก แต่ในการเรียกร้องเอาทรัพย์สินคืนนั้น ท่านว่าต้อง อยู่ในบังคับแห่งเงื่อนไขที่ระบุไว้ในมาตรา ๓๐๒แห่งประมวลกฎหมายนี้
