ค่าใช้จ่ายอันเป็นการจรนั้น ท่านว่าเจ้าของต้องเป็นผู้ออก แต่เพื่อ จะออกค่าใช้จ่ายเช่นว่านี้ หรือค่าใช้จ่ายตามความในมาตราก่อนเจ้าของจะจำหน่ายทรัพย์สิน บางส่วนก็ได้ เว้นแต่ผู้ทรงสิทธิเก็บกินจะเต็มใจทดรองเงินตามที่จำเป็นโดยไม่คิดดอกเบี้ย
