คำสั่งของศาลชั้นต้นที่ไม่รับหรือให้คืนคำคู่ความตามมาตรา ๑๘หรือคำสั่งวินิจฉัยชี้ ขาดเบื้องต้นตามมาตรา ๒๔ซึ่งทำให้คดีเสร็จไปทั้งเรื่องนั้น มิให้ถือว่าเป็นคำสั่งในระหว่างพิจารณา และให้อยู่ภายใน ข้อบังคับของการอุทธรณ์คำพิพากษาหรือคำสั่งชี้ขาดตัดสินคดี
