ให้พนักงานเจ้าหน้าที่หรือผู้มีอำนาจหน้าที่เช่นเดียวกับพนักงานเจ้าหน้าที่ ตามพระราชกำหนดนี้เป็นเจ้าพนักงานตามประมวลกฎหมายอาญา และมีอำนาจหน้าที่เป็นพนักงาน ฝ่ายปกครองหรือตำรวจตามประมวลกฎหมายวิธีพิจารณาความอาญา ทั้งนี้ ตามที่นายกรัฐมนตรี ประกาศกำหนด
