ให้อธิบดีกรมการค้าภายในปฏิบัติหน้าที่ของเลขาธิการจนกว่าจะมีการแต่งตั้ง เลขาธิการตามพระราชบัญญัตินี้ ทั้งนี้ ให้ดำเนินการแต่งตั้งเลขาธิการให้แล้วเสร็จภายในหนึ่งร้อยแปดสิบวัน นับแต่วันที่ได้แต่งตั้งคณะกรรมการการแข่งขันทางการค้าครั้งแรก
