ถ้ามีการฟ้องร้องบังคับตามสิทธิเรียกร้องเป็นคดีอยู่ในศาล ให้ ธอส. เข้าสวมสิทธิ เป็นคู่ความแทน บตท. ในคดีดังกล่าว และในกรณีที่ศาลได้มีคำพิพากษาบังคับตามสิทธิเรียกร้องนั้นแล้ว ก็ให้เข้าสวมสิทธิเป็นเจ้าหนี้ตามคำพิพากษานั้น
