การแสดงเจตนาโดยสำคัญผิดในสิ่งซึ่งเป็นสาระสำคัญแห่งนิติ กรรมเป็นโมฆะ ความสำคัญผิดในสิ่ ซึ่ เป็นสาระสำคัญแห่ นิติ รรมตามวรรคหนึ่ ง ได้แก่ ความสำคัญผิดในลักษณะของนิติกรรม ความสำคัญผิดในตัวบุคคลซึ่งเป็นคู่กรณีแห่งนิติกรรม และความสำคัญผิดในทรัพย์สินซึ่งเป็วัตถุแห่งนิติกรรม เป็นต้น
