ถ้าคู่กรณีต่างได้กระทำการโดยกลฉ้อฉลด้วยกันทั้งสองฝ่าย ฝ่าย หนึ่งฝ่ายใดจะกล่ วอ้างกลฉ้อฉลของอีกฝ่ ยหนึ่ง เพื่อบอกล้างการนั้นหรือเรียกค่าสินไหมทดแทน มิได้
