ถ้ากลฉ้อฉลเป็นแต่เพียงเหตุจูงใจให้คู่กรณีฝ่ายหนึ่งยอมรับ ข้อกำหนดอันหนัยิ่งกว่าที่คู่กรณีฝ่ายนั้นจะยอมรับโดยปกติคู่กรณีฝ่ายนั้นจะบอกล้างการนั้นหา ได้ไม่ แต่ชอบที่จะเรียกเอาค่าสินไหมทดแทนเพื่อความเสียหายอันเกิดจากกลฉ้อฉลนั้นได้
