ข้อ ๒ ผู้ใดมีไว้ในครอบครองวัสดุนิวเคลียร์ตามกฎกระทรวงที่ออกตามมาตรา ๓๘ วรรคหนึ่ง ต้องยื่นคำขอแจ้งการครอบครองวัสดุนิวเคลียร์ พร้อมด้วยเอกสาร หรือหลักฐานตามที่ระบุไว้ในแบบคำขอ ต่อเลขาธิการภายในสามสิบวันนับแต่วันที่มีไว้ในครอบครองวัสดุนิวเคลียร์นั้น
