Preamble

พระราชบัญญัติสิทธิบัตรพ.ศ.๒๕๒๒ ฉบับแก้ไขเพิ่มเติมตามพ.ร.บ.สิทธิบัตร(ฉบับที่๒)พ.ศ.๒๕๓๕ และพ.ร.บ.สิทธิบัตร(ฉบับที่๓)พ.ศ.๒๕๔๒ ภูมิพลอดุลยเดชป.ร. ให้ไว้ณวันที่ ๑๑มีนาคมพ.ศ.๒๕๒๒ เป็นปีที่ ๓๔ในรัชกาลปัจจุบัน พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดชมีพระบรมราชโองการโปรดเกล้าฯให้ ประกาศว่า โดยที่เป็นการสมควรมีกฎหมายว่าด้วยสิทธิบัตรเพื่อคุ้มครองการประดิษฐ์และการ ออกแบบผลิตภัณฑ์ จึงทรงพระกรุณาโปรดเกล้าฯให้ตราพระราชบัญญัติขึ้นไว้โดยคำแนะนำและยินยอมของ สภานิติบัญญัติแห่งชาติทำหน้าที่รัฐสภาดังต่อไปนี้

การใช้สิทธิตามสิทธิบัตร มาตรา ๔๕ผู้ทรงสิทธิบัตรจะขอให้บันทึกคำยินยอมให้บุคคลอื่นใช้สิทธิตามสิทธิบัตร ของตนลงในทะเบียนสิทธิบัตรตามหลักเกณฑ์และวิธีการที่กำหนดในกฎกระทรวงก็ได้ เมื่อได้บันทึกคำยินยอมลงในทะเบียนสิทธิบัตรแล้วและมีผู้มาขอใช้สิทธิบัตรนั้นให้อธิบดีอนุญาต ให้บุคคลซึ่งขอใช้สิทธิตามสิทธิบัตรนั้นใช้สิทธิบัตรได้ตามเงื่อนไขข้อจำกัดสิทธิและค่าตอบแทน ในการใช้สิทธิตามสิทธิบัตรที่ผู้ทรงสิทธิบัตรและผู้ขอใช้สิทธิตามสิทธิบัตรตกลงกันหากทั้งสอง ฝ่ายตกลงกันไม่ได้ภายในระยะเวลาที่อธิบดีกำหนดให้อธิบดีกำหนดเงื่อนไขข้อจำกัดสิทธิและ ค่าตอบแทนตามที่อธิบดีพิจารณาเห็นสมควร คำวินิจฉัยของอธิบดีตามวรรคสองคู่กรณีอาจอุทธรณ์ต่อคณะกรรมการภายในสามสิบวันนับแต่ วันที่ได้รับแจ้งคำวินิจฉัยนั้นคำวินิจฉัยของคณะกรรมการให้เป็นที่สุด การขอใช้สิทธิและการอนุญาตตามวรรคสองให้เป็นไปตามหลักเกณฑ์และวิธีการที่ กำหนดในกฎกระทรวง เมื่อได้มีการบันทึกคำยินยอมตามวรรคหนึ่งให้ลดค่าธรรมเนียมรายปีสำหรับสิทธิบัตรนั้น ลงตามที่กำหนดในกฎกระทรวงแต่ต้องไม่น้อยกว่ากึ่งหนึ่งของค่าธรรมเนียมรายปี
