ผู้ใดแจ้งข้อความ ให้ถ้อยคำ หรือตอบคำถามด้วยถ้อยคำอันเป็นเท็จ หรือ ไม่ตอบคำถามของพนักงานศุลกากรตามที่พระราชบัญญัตินี้กำหนดให้ตอบ ต้องระวางโทษจำคุกไม่เกิน หกเดือน หรือปรับไม่เกินห้าแสนบาท หรือทั้งจำทั้งปรับ
