นายเรือผู้ใดควบคุมเรือที่บรรทุกของอยู่ในเขตท่าที่เป็นด่านศุลกากร และ ปรากฏว่าเรือลำดังกล่าวเบาลอยตัวขึ้น โดยนายเรือไม่สามารถพิสูจน์ได้ว่าได้มีการขนของขึ้นโดยชอบ ด้วยกฎหมาย ต้องระวางโทษปรับไม่เกินหนึ่งล้านบาท และให้ศาลมีอำนาจสั่งริบเรือนั้นได้
