Preamble

พระราชบัญญัติ คุ้มครองแรงงาน พ.ศ. ๒๕๔๑ ภูมิพลอดุลยเดช ป.ร. ให้ไว้ ณวันที่ ๑๒กุมภาพันธ์ พ.ศ. ๒๕๔๑ เป็นปีที่ ๕๓ในรัชกาลปัจจุบัน พระบาทสมเด็จพระปรมินทรมหาภูมิพลอดุลยเดชมีพระบรมราชโองการโปรดเกล้าฯ ให้ประกาศว่า โดยที่เป็นการสมควรปรับปรุงกฎหมายว่าด้วยการคุ้มครองแรงงาน จึงทรงพระกรุณาโปรดเกล้าฯให้ตราพระราชบัญญัติขึ้นไว้โดยคำแนะนำและยินยอม ของรัฐสภาดังต่อไปนี้

มาตรา ๑๔๔๕๐ นายจ้างผู้ใดฝ่าฝืนหรือไม่ปฏิบัติตามมาตรา ๑๐มาตรา ๒๒ มาตรา ๒๔มาตรา ๒๕มาตรา ๒๖มาตรา ๓๗มาตรา ๓๘มาตรา ๓๙มาตรา ๓๙/๑มาตรา ๔๐ มาตรา ๔๒มาตรา ๔๓มาตรา ๔๖มาตรา ๔๗มาตรา ๔๘มาตรา ๔๙มาตรา ๕๐มาตรา ๕๑ มาตรา ๖๑มาตรา ๖๒มาตรา ๖๓มาตรา ๖๔มาตรา ๖๗มาตรา ๗๐มาตรา ๗๑มาตรา ๗๒ มาตรา ๗๖มาตรา ๙๐วรรคหนึ่ง กฎกระทรวงที่ออกตามมาตรา ๙๕มาตรา ๑๑๘วรรคหนึ่ง ไม่จ่าย ค่าชดเชยพิเศษแทนการบอกกล่าวล่วงหน้าหรือค่าชดเชยพิเศษตามมาตรา ๑๒๐มาตรา ๑๒๑หรือ มาตรา ๑๒๒ต้องระวางโทษจำคุกไม่เกินหกเดือนหรือปรับไม่เกินหนึ่งแสนบาทหรือทั้งจำทั้งปรับ๕๑ ในกรณีที่นายจ้างฝ่าฝืนหรือไม่ปฏิบัติตามมาตรา ๓๗มาตรา ๓๘มาตรา ๓๙ มาตรา ๓๙/๑มาตรา ๔๒มาตรา ๔๗มาตรา ๔๘มาตรา ๔๙หรือมาตรา ๕๐เป็เหตุให้ลูกจ้าง ได้รับอันตรายแก่กายหรือจิตใจ หรือถึงแก่ความตาย ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกิน สองแสนบาทหรือทั้งจำทั้งปรับ
