สถาบัการเงินที่ดำเนินการตามมาตรา ๗๓วรรคหนึ่ง หากมีการโอน สินทรัพย์ที่มีหลักประกันอย่างอื่นที่มิใช่สิทธิจำนอง สิทธิจำนำ หรือสิทธิอันเกิดขึ้นแต่การค้ำประกันซึ่ง ย่อมตกไปได้แก่ผู้รับโอนตามมาตรา ๓๐๕แห่งประมวลกฎหมายแพ่งและพาณิชย์แล้วให้หลักประกัน อย่างอื่นนั้นตกแก่สถาบันการเงินที่ควบกันหรือที่รับโอนกิจการ แล้วแต่กรณี
