ในกรณีที่ผู้เริ่มจัดตั้งบริษัทคนหนึ่งคนใดตายหรือถอนตัว ผู้จองหุ้นจะถอนคำขอ การจองหุ้นก็ได้ โดยมีหนังสือแจ้งให้ผู้เริ่มจัดตั้งบริษัททราบภายในเจ็ดวันนับแต่วันที่ได้รับแจ้งตามมาตรา ๒๐(๒)
