การที่บุคคลใดสละมรดกของบุคคลอีกคนหนึ่งนั้น ไม่ตัดสิทธิ ของผู้สละที่จะรับมรดกแทนที่บุคคลอีกคนหนึ่งนั้นในการสืบมรดกบุคคลอื่น มาตรา ๑๖๔๐แก้ไขเพิ่มเติมโดย พระราชบัญญัติให้ใช้บรรพ ๑ที่ได้ตรวจชำระใหม่ พ.ศ.๒๕๓๕
