สมาชิกวุฒิสภาจะเป็นรัฐมนตรี ผู้ดำรงตำแหน่งทางการเมืองอื่น หรือผู้ดำรง ตำแหน่งในองค์กรอิสระตามรัฐธรรมนูญ มิได้ บุคคลผู้เคยดำรงตำแหน่งสมาชิกวุฒิสภาและสมาชิกภาพสิ้นสุดลงมาแล้วยังไม่เกินสองปี จะเป็นรัฐมนตรีหรือผู้ดำรงตำแหน่งทางการเมือง มิได้
