ผู้ใดรู้ว่าข้อมูลคอมพิวเตอร์ในความครอบครองของตนเป็นข้อมูลที่ ศาลสั่งให้ทำลายตามมาตรา ๑๖/๑ผู้นั้นต้องทำลายข้อมูลดังกล่าว หากฝ่าฝืนต้องระวางโทษกึ่งหนึ่ง ของโทษที่บัญญัติไว้ในมาตรา ๑๔หรือมาตรา ๑๖แล้วแต่กรณี
