ถ้าสิทธิเหนือพื้นดินนั้นไม่มีกำหนดเวลาไซร้ ท่านว่าคู่กรณีฝ่ายใด จะบอกเลิกเสียในเวลาใดก็ได้ แต่ต้องบอกล่วงหน้าแก่อีกฝ่ายหนึ่งตามสมควร ถ้ามีค่าเช่าซึ่ง จำต้องให้แก่กันไซร้ ท่านว่าต้องบอกล่วงหน้าปีหนึ่ง หรือให้ค่าเช่าปีหนึ่ง
